Structural inspection according to Decree 136/2020/ND-CP

On November 24, 2020, the Government issued Decree 136/2020/ND-CP detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting. Law on Fire Prevention and Fighting (replacing Decree No. 79/2014/ND-CP dated July 31, 2014 of the Government). This Decree takes effect from January 10, 2020.

The Fire Prevention and Rescue Police Department introduces a number of contents related to the inspection of structures and fire prevention components, specifically as follows:

Some new points in the inspection of structures and fireproofing components

  • Section 4, Appendix V of Decree No. 79/2014/ND-CP dated July 31, 2014 of the Government regulates fire protection inspection for fire retardant materials and substances. However, Section 5, Appendix VII of Decree No. 136/2020/ND-CP dated November 24, 2020 of the Government regulates fire protection inspection for structural samples and structural samples protected by substances or fireproof material.
  • Thus, according to the provisions of Decree No. 136/2020/ND-CP, the fire resistance limit of paint, fireproof mortar or materials used to produce doors and fire partitions will not be tested, but the fire resistance limit will be tested. fire resistance limit of structures (fire doors, fire partitions, fire valves, fire glasses…), structures (beams, columns, floors, walls…) protected by fire-resistant substances and materials (anti-fire paint) fire, fireproof mortar or other fireproof materials…).
  • The purpose of using structures protected with fireproof substances or materials is to increase the fire resistance level of houses and buildings.

For example: A prefabricated steel frame house whose load-bearing parts are steel structures with a fire resistance limit of R15 (15 minutes) has a fire resistance level of level IV, however, if these steel structures are protected by Fireproof paint and achieving the fire resistance limit of R90 will increase the fire resistance level for the house to level II (specified in Table 4 of Regulation 06:2020/QCBXD).

  • For each type of cross-section, shape (I, H, round, box, hollow…) and size of different steel structures and different layout positions are protected with anti-oxidants or materials. All fires must be tested for fire resistance limits to get specific, corresponding results.

For example: A construction project using steel structures has columns, beams, trusses with different cross-sections, shapes (round I, H, box…) and sizes arranged in different positions. each other (in the middle of the building, at the corner of the building or only one side in contact with the fire surface…) is protected with a type of fireproof paint that requires a fire resistance limit of R60 minutes for each type of column and beam. , this steel truss, depending on each shape, size and arrangement location, will be tested to reach the R60 minute fire resistance limit to determine each specific structure of the corresponding protective coating layer.

  • Standards for testing various types of fire-stopping structures and components:
    • For fire doors: TCVN 9383-2012;
    • Fire-resistant glass: ISO 3009:2003;
    • Non-load-bearing vertical partitions (curtains, curtains, fire partitions): TCVN 9311-1:2012; TCVN 9311-8:2012;
    • Air duct: ISO 6944-1:2008;
    • Fire prevention valve: ISO 10294-2:1996.
    • Protective structure made of fireproof substances and materials: Incorporating standards BS EN 13381, ISO 834-10 and ISO 834-11.

2. Issuance of Inspection Certificate for structural samples protected by fireproof substances or materials; Model of fire prevention components

Pursuant to Decree No. 136/2020/ND-CP, the Ministry of Public Security has developed a Draft National Technical Regulation on fire protection vehicles to serve the inspection of fire protection vehicles after Decree No. 136/2020/ND -CP is in effect. This standard is expected to be issued in the second quarter of 2021.

  • From January 10, 2021 to before the National Technical Regulations on Fire Fighting Vehicles takes effect: Based on the test results, the Fire Prevention and Fighting Police Department and CNCH will consider issuing an Inspection Certificate for batch of fire prevention components (fire doors, fire partitions, fire valves, fire screens); The structure is protected by fireproof substances or materials.
  • The moment when the National Technical Regulations on fire prevention and fighting equipment takes effect: The issuance of Inspection Certificates for structural samples and fire prevention components samples is carried out according to the provisions of Article 38 of Decree 136/ 2020/ND-CP dated November 24, 2020 and National Technical Regulations on Fire Prevention and Control (in the direction of only testing samples and sample testing certificates will be valid for 03 years or 01 year depending on the means domestically produced or imported).

3. The unit performs fire resistance limit testing of structural samples protected by fireproof substances or materials; Model of fire prevention components

The unit is allowed to test the fire resistance limits of structural samples protected by fireproof substances or materials; Samples of fire prevention components (fire doors, fire partitions, fire valves, fire curtains…) are units that must have testing capacity according to the provisions of corresponding regulations and standards. Currently, this testing can be performed at the Institute of Construction Science and Technology – Ministry of Construction (IBST).

4. Procedures for testing structural samples and fire-stop components:

4.1. Profile components

4.1.1. Components of dossier requesting inspection and issuance of certificate of inspection of structural samples and fire prevention components:

  • Written request for inspection and issuance of Certificate of inspection of fire prevention and fighting equipment (Form No. PC26 issued with Decree 136/2020/ND-CP) of the unit directly producing, constructing or importing Finalize samples of fireproof structures and fireproofing structures, together with a proposal for estimated time for sample fabrication and testing time (if any);
  • Certificate of origin or release of material components and accessories serving the production and construction of fireproof structural models and fireproofing components;
  • Certificate of quality of material components and accessories serving the production and construction of fireproof structure samples and fireproofing structures (if any);
  • Technical documents of fireproof structure models and fireproof structures, including:
    • Technical documents of material components and accessories;
    • Construction drawings;
    • Construction process;
    • Document of self-assessment and commitment to quality and shelf life of the manufacturing and construction unit.

4.1.2. Components of dossier requesting issuance of certificate of inspection of fireproof structure and fireproof structure samples:

  • Document components mentioned in section 4.1;
  • Minutes of inspection of structural samples and fire prevention components of a unit authorized by the Ministry of Public Security to carry out the inspection or a business establishment providing consulting services for inspection and technical inspection of fire prevention and fighting. Confirmed eligibility to provide inspection and technical inspection services on fire prevention and fighting, accompanied by a report evaluating test results from a specialized laboratory and a record of confirmation of participation in supervision by a representative of the Police Department. Supervision of fire prevention and rescue;
  • Minutes of inspection and evaluation of the production process, sampling of fireproof structures and fireproofing structures (Form No. PC28 issued with Decree 136/2020/ND-CP) with the participation and confirmation of supervision of Representative of the Fire and Rescue Police Department.

4.2. Time limit for processing documents

The time limit for processing documents is implemented according to the provisions of Clause 10, Article 38 of Decree No. 136/2020/ND-CP dated November 24, 2020 of the Government.

4.3. Where to submit documents and receive inspection results

Dossier to request a certificate of inspection of structural samples and fireproof components is submitted and results are received at the Department of receiving and returning results of administrative procedures on fire prevention and fighting of the Fire Prevention and Fighting Police Department (One-Stop Department) at Floor 1, address: No. 2A Dinh Le, Trang Tien, Hoan Kiem, Hanoi./.
